PortNexus Corporation built the MyFlare app as a Commercial app. This SERVICE is provided by PortNexus Corporation and is intended for use, as is. This app is intended to assist the user when they find themselves in a potentially dangerous situation. The app sends messages to people that the user specifies. The messages are sent electronicaly by email, sms and other comunication technologies.
This page is used to inform users regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service.
If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.
Information Collection and Use
For a better experience, while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to first name, last name, phone number, date of birth, medical conditions. All of this information is optional. Profile information that you enter is stored on your device. However, as described below, your name, phone number, location, and other event information may be transmitted to and stored on our server when you activate an emergency feature.
The app does not use any third party services that may collect information used to identify you.
We want to inform you that whenever you use our Service, in a case of an error (i.e. bug) in the app we collect data and information on your phone called "Log Data". This Log Data may include information such as your device model, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.
Phone Number Collection and Use
In the following cases your phone number will be uploaded to our server:
In these cases, your phone number will be stored with an indication that you activated one of these modes. This data is used for statistical purposes. This data is not sent to any 3rd party for any reason.
In addition, if you are a school administrator (e.g. teacher, principal, security personnel) then your phone number will be sent to our server to identify your role at the school. In this case, your phone number is not stored in the server.
Location Data Collection and Use
When you press the Flare button on the app, the app uses location information to inform the individuals, who you specify, of your current location. Your location is critical information to provide to others to assist you in an emergency. Your location information is sent only in the case of an emergency. In addition, if you enter a "Gathered Safely Zone" and an emergency situation occurs, your location information is sent to is emergency response individuals specified by the owner of the "Gathered Safely Zone". You have the ability, within the app,to opt out of having any information sent to these emergency response individuals.
User Profile Image Collection and Use
When you choose to add your image to your profile then that image will be sent to the emergency contacts that that you have specified. This is so that emergency personnel will have the ability to help you when you are in an emergency situation. The profile image is optional - you are not required to set a profile image. When you start an emergency flare then this image is uploaded securely to our server at https://cloud1.mobileassociate.com and forwarded to your emergency contacts. The image is not stored on our server.
Data Retention
Information stored only on your device remains on the device until you delete it, clear the MyFlare app data, or uninstall MyFlare. Personal information stored on our servers, including phone numbers and emergency event records, is retained for the life of the MyFlare service unless it is deleted in response to a verified deletion request. We retain these records to document emergency and safety events, maintain service security, investigate incidents or misuse, and comply with applicable legal obligations. Information that this policy identifies as not stored on our server is not retained by us.
Data Deletion Requests
You may request deletion of personal information stored on our servers by visiting https://www.portnexus.com/#contact. Enter your name and email address, select "Support" under "What area do you need help with," and begin the Message field with "MyFlare Data Deletion Request." Include the phone number associated with your use of MyFlare and, if applicable, the approximate date of the emergency event so that we can locate the relevant records. We may take reasonable steps to verify your identity before processing the request.
Deletion requests are handled manually. We will delete or de-identify personal information that we can reasonably associate with you, except when retention is reasonably necessary to document a safety incident, protect users or PortNexus, prevent fraud or misuse, comply with a legal obligation, or establish, exercise, or defend legal claims. If information must be retained for one of these reasons, it will be limited to that purpose and deleted or de-identified when the retention reason no longer applies. Information stored only on your device can be removed by clearing the MyFlare app data or uninstalling MyFlare.

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.
This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse cookies, you may not be able to use some portions of this Service.
